Disclaimer for online loan applications

I acknowledge and consent to Felix Consulting GmbH forwarding my application to Cembra Money Bank AG or Bank-Now AG (hereinafter both referred to as the “financing institution”) via the internet, email or by fax/post. Furthermore, I confirm the following:

Application review and credit score information: I hereby confirm the correctness of all information disclosed and permit the financing institute to obtain information from third parties, in particular banks, the Central Office for Credit Information (ZEK), the authorities (e.g. debt enforcement and tax offices, residents’ registration offices, child and adult protection agencies), credit agencies, credit intermediaries, employers, affiliates of the financing institute and also the Consumer Credit Information Office (IKO), in the context of reviewing my application and administering the contractual relationship. For the aforementioned purposes, I release these entities from their obligation to maintain bank-client confidentiality as well as any postal or official secrecy. I also authorise the financing institute to inform the ZEK and IKO of the contract application and to notify these offices and others in the case of relevant statutory obligations. The information to be disclosed may include the type of loan or financing, the amount and terms as well as the personal details of the applicant and all qualifying outstanding debts or abuses. I acknowledge the rights of the ZEK and IKO to notify their members of the disclosed information. The financing institute is entitled to refuse the application without stating reasons.

Collaborations with intermediaries: for applications received from an intermediary, the financing institute is entitled to disclose information required within the scope of application/creditworthiness checks and the conclusion and processing of contracts.

Information on partners: in the case that I have disclosed information on my spouse/registered partner, I hereby confirm (i) that I have informed my partner of this application, (i) that the financing institute reserves the right to check the aforementioned information by directly contacting my partner and, (i) that my partner grants their permission for the financing institute to obtain information concerning them on the aforementioned points (including submitting exploratory enquiries to the ZEK).

Data processing: I authorise the financing institute to process and analyse my data for risk management and marketing purposes in order to create a profile. I also authorise the financing institute and affiliates of the financing institute to advertise other products and services to me. I am entitled to revoke this authorisation for data processing for marketing purposes and sending information at any time.

Collaborations with service providers (outsourcing): the financing institute may outsource certain services to third parties (“service providers”), in particular those related to processing business transactions, IT security and system control, market research and cultivation, calculating business relevant credit and market risks and the administration of contractual relationships (e.g. processing applications and contracts, debt collection, communication with clients).

These services providers will be provided with all information required to fulfil their contractual obligations from the financing institute and are entitled to transfer this information abroad. Service providers, their employees and subcontractors are contractually obligated to comply with Swiss data privacy regulations, to maintain secrecy with regard to bank-client confidentiality in accordance with Swiss banking law and to maintain discretion. In this respect, I agree to the disclosure of my information to service providers located in states with the same level of data privacy regulations in place as Switzerland.

I hereby confirm that I consent to the use of electronic communication between the financing institute, myself and the intermediary. I also agree to the online transfer of data and am aware that the internet is an open network accessible to everyone. Accordingly, the aforementioned intermediary and the financing institute are not able to guarantee the confidentiality of information transferred online. It can therefore not be excluded that a third party may be able to deduce the existence of an existing or planned business relationship (banking relationship at most) between myself and the financing institute.

Lending is prohibited if it will lead to overindebtedness (Section 3 of the Swiss Fair-Trade Law).
